Terms of Service
These terms are the agreement between you and ESGR Studios Private Limited ("we") for using the SpawnPoint app and service. By creating an account you accept these terms and the Community Rules, which are part of them. Our Privacy Policy explains how we use data.
1. Who can use SpawnPoint
- You must be at least 13 years old. If the law where you live requires an older age to agree to these terms, you must be that age.
- You must not use SpawnPoint if we have banned your account.
2. Your account
- Your account is tied to a phone number that you control and verify by SMS. One number is one account.
- Give a display name that does not pretend to be someone else, or to be SpawnPoint or its staff.
- Keep your phone, your verification codes and your two-step verification PIN to yourself. You are responsible for what is done from your account.
- If you lose access to the phone number, you may lose access to the account. Your message history is stored on your phone; we cannot restore it. An optional backup to your own Google Drive is available, and we cannot recover its password or key.
3. Acceptable use
You must follow the Community Rules. In addition you must not:
- break the law or help others to do so;
- access the service by any means other than the app, or interfere with it, overload it, probe it or bypass its limits or security;
- create accounts in bulk or by automated means, or send bulk or automated messages;
- collect information about other users without their consent;
- sell, resell or rent access to the service or to a paid plan.
4. Your content
You keep all rights in what you send and share. You are responsible for it, and you must have the right to share it.
You give us a limited, non-exclusive, royalty-free, worldwide licence to store, copy, transmit and display your content only as needed to operate the service for you: to deliver it to the people and spaces you choose and to keep it available to them. Message content and attachments are end-to-end encrypted, so we handle them in encrypted form. Your display name, About text, game IDs, and the names of groups and communities are readable by us and shown to other users as the app is designed to show them. This licence ends when the content is deleted from our service, except that copies already delivered to other people stay with them.
When you report content, you choose what to include in the report, and we may use it to enforce these terms and to meet legal duties.
5. Moderation and enforcement
We cannot read your chats. We act on reports from users and on the limited information our service can see. If an account, a message, a group or a community breaks these terms, we may:
- remove a message, a status or a media post, or reset a name, About text, game ID or profile photo;
- warn the account, limit it from starting new contact for a time, suspend it for a time, or ban it;
- freeze, disable or remove a group or community.
Some of these steps are taken automatically by rules that count reports from different established accounts, without a person reviewing them first. The app tells you when a restriction applies to your account, the category, whether it was automatic and when it ends.
You can appeal each restriction once, in the app under You > Safety, within 180 days. How reports, enforcement and appeals work is described in the Community Rules.
6. Paid plans
- Free use. Messaging, groups and joining communities work without a paid plan.
- Sold only through Google Play. The Plus, Pro and Max plans are subscriptions bought in the app through Google Play's billing system. We do not sell plans any other way. The price, the billing period and what a plan includes are shown in the app before you buy, and the price is the one Google Play charges.
- Automatic renewal. A subscription renews automatically at the end of each billing period, and Google Play charges the payment method on your Google account, until you cancel.
- Cancelling. Cancel at any time in Google Play subscriptions. After you cancel, the plan stays active until the end of the period already paid for, and then it ends. Uninstalling the app or deleting your SpawnPoint account does not cancel a subscription.
- Refunds follow Google Play's rules and are requested from Google Play, without affecting any rights the law gives you.
- Payment problems. If a payment fails, Google Play may keep the plan active for a grace period while it retries. If the subscription is put on hold or paused, the plan's benefits stop until it resumes. If Google Play refunds or revokes a purchase, the plan ends at once.
- One account. A purchase belongs to the SpawnPoint account it was bought for and cannot be moved to another account.
- When a plan ends, your account returns to the free plan. Your chats, groups and community memberships stay.
Community media after a plan ends. A paid plan allows the owner of a community to keep more media on the community's shelf than the free plan does. If the owner's plan ends, the media above the free plan's allowance is kept for 30 days. We warn the owner in the app during that time. If no plan that covers the media is active when the period ends, the oldest posts above the free allowance are deleted and cannot be restored. Subscribing again before the period ends keeps them.
We may change what plans include or cost for future billing periods. We will not reduce what a plan gives during a period you have already paid for. Price changes are handled through Google Play, which notifies you and, where required, asks for your agreement.
7. Ending the agreement
- You can stop at any time by deleting your account in the app or on the account deletion page. If you own a group or community, pass ownership to another member first.
- We may suspend or ban an account that breaks these terms, as described in section 5, and may close an account where the law requires it.
- After an account is deleted, some records are kept for safety and legal reasons, as listed in the Privacy Policy. A ban continues to apply to the phone number.
8. Changes to the service and to these terms
We may add, change or remove features. When we change these terms we publish the new version here with a new effective date, and when a change is important we ask you to accept the new version in the app before you continue to send or post.
Sections 9 to 11 need counsel. They are written in a neutral, common form and have not been adapted to any country's consumer, liability or dispute law. The governing law and courts are placeholders.
9. Disclaimers
We provide SpawnPoint with reasonable care and skill, but we do not promise that it will always be available, uninterrupted, secure or free of errors, or that messages will always be delivered. Other users are responsible for what they send. To the extent the law allows, the service is provided "as is", without warranties beyond those that cannot be excluded by law.
10. Limitation of liability
Nothing in these terms limits liability that cannot be limited by law, or rights you have as a consumer that cannot be waived. Subject to that, and to the extent the law allows, we are not liable for indirect or consequential loss, for loss of data that is stored only on your device, or for the conduct or content of other users, and our total liability to you is limited to the greater of the amount you paid for a plan in the twelve months before the claim and the minimum amount the law requires.
11. Governing law and disputes
These terms are governed by the laws of India. Disputes are to be brought before the courts in Chennai, Tamil Nadu, India, unless the law where you live gives you the right to bring them elsewhere. Please contact us first; see Grievance and contact.
